MCCM CLUB TERMS AND CONDITIONS
INTRODUCTION
The MCCM Club is a community created by MCCM Medical Cosmetics, through its representative in Portugal ABSTRACT REVELATION, LDA, with the aim of providing its members with access to exclusive services, advantages, and content, promoting a differentiated experience with the brand.
Membership in the MCCM Club is free and reserved for natural persons of legal age. Registration is intended exclusively for final consumers, and participation by companies, distributors, or resellers is prohibited, unless expressly authorized by MCCM Medical Cosmetics.
PRELIMINARY INFORMATION
These Terms and Conditions regulate the relationship between MCCM Medical Cosmetics and the members of the MCCM Club, along with any specific conditions that may be established for specific campaigns, promotions, or events.
By registering, the user expresses their full and unconditional acceptance of these Terms and Conditions, and must click the “I accept the Terms and Conditions” button to validate membership. If they do not accept, they cannot join the MCCM Club.
MCCM Medical Cosmetics may communicate with members via email, SMS, or other digital means related to membership. These communications are considered an integral part of the membership experience and do not constitute direct marketing, unless the user's explicit consent is given.
REGISTRATION AND MEMBER ACCOUNT
Registration requires the correct and complete filling of the mandatory fields of the form. The member undertakes to provide true and updated information.
The member is responsible for the confidentiality of their password and the use of their account, undertaking not to share it with third parties. The improper use of another person's data or identity constitutes a legal infringement and may give rise to civil and criminal liability.
MCCM Medical Cosmetics adopts appropriate technical and organizational measures to protect the personal data and security of its members' accounts, in compliance with the General Data Protection Regulation (GDPR) and applicable national legislation.
ACTIVITIES AND BENEFITS
Members of the MCCM Club have access to promotions, advantages, events, exclusive content, and communications about MCCM products and services.
The sending of promotional communications depends on the member's explicit consent, which can be withdrawn at any time through the cancellation link included in each message or by direct contact with MCCM Medical Cosmetics.
MCCM Medical Cosmetics reserves the right to change, suspend, or terminate any benefit or campaign of the MCCM Club, subject to prior digital communication.
RESPONSIBILITY AND CONDUCT
Members undertake to use the MCCM Club and its services in an ethical, legal, and responsible manner, refraining from sharing offensive, discriminatory, pornographic, illicit content, or content that violates the rights of third parties.
The use of the website for fraudulent purposes, dissemination of malicious software, spam, or any other behavior that may compromise the security of the platform or other users is expressly prohibited.
Any damage caused to MCCM Medical Cosmetics or to third parties as a result of improper use shall be the sole responsibility of the member.
DISCLAIMER OF LIABILITY
MCCM Medical Cosmetics does not guarantee that the website and its platforms are free from errors or interruptions, but undertakes to adopt reasonable security, maintenance, and update measures.
The company may temporarily suspend access to the MCCM Club for technical, security, or maintenance reasons, notifying users whenever possible.
MCCM Medical Cosmetics is not responsible for failures resulting from external factors, such as network unavailability, viruses, system errors, use of outdated browsers, or third-party failures.
PERSONAL DATA PROTECTION
The processing of personal data is carried out by MCCM Medical Cosmetics (ABSTRACT REVELATION, LDA), in compliance with Regulation (EU) 2016/679 (GDPR) and Law No. 58/2019, exclusively for the management of MCCM Club membership and related communications.
The legal basis for processing is the data subject's consent and/or the performance of the membership contract.
The data will be retained for the period necessary to maintain the membership relationship and, after cancellation, for the legal period required to fulfill contractual or fiscal obligations.
The data subject may exercise their rights of access, rectification, erasure, restriction, objection, and portability, by written request to the e-mail: privacy@mesosystem.com or by mail to: Zona Industrial da Gandra, Lote 10, Caldas das Taipas, 4805-017 Guimarães, Portugal, with the reference “GDPR Rights”.
If the data subject considers that their rights have not been respected, they may submit a complaint to the National Data Protection Commission (www.cnpd.pt).
SHARING AND TRANSFER OF PERSONAL DATA
Member data may be shared with partner entities or distributors of MCCM Medical Cosmetics for the execution of promotional, logistical, or technical support activities.
Whenever there is an international transfer of data to countries outside the European Union, this will only be carried out to entities that offer adequate guarantees of protection, under the terms of Article 46 of the GDPR, namely through the signing of Standard Contractual Clauses approved by the European Commission.
IMAGE RIGHTS
Members participating in MCCM Club activities, events, or campaigns authorize the use of their name, image, and voice for brand communication and promotion purposes, without the right to remuneration.
This authorization may be revoked at any time by written request to info@mesosystem.com.
INTELLECTUAL AND INDUSTRIAL PROPERTY
All website content – including texts, images, videos, logos, design, and software – are the property of MCCM Medical Cosmetics or third-party licensors, and are protected by copyright and industrial property rights.
Users may not reproduce, distribute, modify, or commercially exploit any content without prior written authorization from MCCM Medical Cosmetics.
Whenever a member publishes content (such as comments, photographs, or videos) on MCCM platforms, they declare that they hold the rights thereto and grant MCCM Medical Cosmetics a non-exclusive, free, and worldwide license to use them within the scope of the MCCM Club and its communications.
MODIFICATIONS TO THE TERMS AND CONDITIONS
MCCM Medical Cosmetics reserves the right to change, update, or eliminate, totally or partially, these Terms and Conditions.
Changes will take effect upon their publication, with members being notified by e-mail or through the website. The continuation of the use of the MCCM Club after notification implies the acceptance of the new conditions.
TERMINATION OF MEMBERSHIP
Members may request their withdrawal from the MCCM Club via e-mail to info@mesosystem.com. The account cancellation implies the deletion of personal data, except when it must be retained due to a legal obligation.
MCCM Medical Cosmetics may cancel the membership of any user who violates these Terms and Conditions or maintains the account inactive for more than 24 months, subject to 30 days' prior notice.
APPLICABLE LAW AND DISPUTE RESOLUTION
These Terms and Conditions are governed by Portuguese legislation.
In the event of a consumer dispute, the consumer may resort to an Alternative Dispute Resolution (ADR) Entity.
