3. ACCESS TO THE WEBSITE
Access to and browsing of the website are generally available without charge and do not necessarily require registration.
Certain services, areas or purchasing functions may require the creation of a customer account.
Where an account is created, the Customer is responsible for maintaining the confidentiality of their username, password and other access credentials.
Account credentials are personal and must not be transferred, shared or made available to unauthorised third parties.
The Customer must immediately notify MCCM if they suspect unauthorised access to their account.
MCCM reserves the right, where reasonably necessary and subject to applicable law, to suspend, restrict or terminate access to an account where there is evidence of misuse, fraud, security concerns, breach of these Terms or other legitimate reasons.
4. ELIGIBILITY AND PROFESSIONAL USE
MCCM Medical Cosmetics supplies products that are intended primarily for professional use.
Certain products may be intended to be applied, administered or used only by appropriately trained or qualified professionals, depending on the nature of the product and the legislation applicable in the destination country.
By placing an order, the Customer confirms that they:
-
are legally entitled to purchase and receive the relevant products;
-
understand the intended professional nature of the products;
-
will use or apply the products only in accordance with applicable laws, instructions and professional standards;
-
will ensure that any person applying or using the products is appropriately qualified where such qualification is required; and
-
will comply with all applicable storage, handling, safety and regulatory requirements.
MCCM does not undertake to determine whether a Customer is legally authorised to use a product in their particular jurisdiction unless MCCM is expressly required to do so by applicable law.
The Customer remains responsible for determining whether the products are suitable and legally available for the intended professional use in the relevant jurisdiction.
5. INTERNATIONAL ORDERS, IMPORTATION AND REGULATORY REQUIREMENTS
MCCM sells products to customers in different countries. Regulatory, customs, import and professional requirements may vary significantly between jurisdictions.
For international orders, the Customer is responsible for determining, before placing an order, whether the products may legally be imported, received, stored and used in the destination country.
Where applicable, the Customer acts as the importer of record and assumes responsibility for complying with the laws and requirements of the destination country.
This includes, where applicable:
-
import licences or authorisations;
-
customs clearance;
-
product registrations;
-
professional licences or qualifications;
-
permits;
-
declarations;
-
customs duties;
-
VAT or other taxes;
-
import fees;
-
local regulatory requirements; and
-
any restrictions applicable to professional or cosmetic products.
5.1 Customer Responsibility
The Customer is responsible for ensuring that the order can legally enter the destination country.
MCCM may provide commercially reasonable assistance or documentation available to it, where appropriate, but such assistance does not transfer responsibility for importation or regulatory compliance to MCCM.
Where reasonably necessary, MCCM may request additional information or documentation before dispatching an order.
5.2 Customs Delays, Refusals and Restrictions
MCCM shall not be responsible for delays, additional costs, refusal of entry, seizure, destruction, return or other consequences caused by:
-
customs authorities;
-
import restrictions;
-
local regulatory requirements;
-
missing licences or permits;
-
incorrect information supplied by the Customer;
-
failure by the Customer to comply with local requirements; or
-
circumstances outside MCCM's reasonable control.
Where an order is returned to MCCM because it could not be delivered or imported due to circumstances attributable to the Customer or the destination country, the Customer may be responsible for the associated shipping, return, customs, storage and administrative costs, to the extent permitted by law.
6. ORDERING AND CONTRACT FORMATION
Product information displayed on the website constitutes an invitation to purchase and does not, by itself, constitute MCCM's final acceptance of an order.
An order is submitted when the Customer completes the checkout process and confirms the purchase.
MCCM may refuse or cancel an order where reasonably justified, including in cases involving:
-
product unavailability;
-
apparent pricing or technical errors;
-
suspected fraud or misuse;
-
inability to verify required information;
-
legal or regulatory restrictions;
-
inability to deliver to the specified destination;
-
import restrictions;
-
payment failure; or
-
circumstances outside MCCM's reasonable control.
Where an order is cancelled after payment has been received, MCCM will arrange the appropriate reimbursement in accordance with applicable law.
7. PRODUCT INFORMATION
MCCM makes reasonable efforts to ensure that product descriptions, images, technical information, availability and other information displayed on the website are accurate and up to date.
However, minor differences may occur between product images and the actual product, including differences in packaging, labelling, colour or presentation, particularly where manufacturers update packaging or labelling.
Such differences do not necessarily constitute a product defect or non-conformity where the product supplied remains the product ordered and complies with applicable requirements.
MCCM reserves the right to correct typographical, technical, pricing or other errors.
8. PRICES AND TAXES
Unless otherwise indicated, prices displayed on the website are expressed in the currency indicated at checkout.
Applicable taxes, VAT, shipping costs, customs duties and other charges will be presented or calculated as required by the applicable transaction and destination.
For international orders, charges imposed by the destination country, including customs duties, import taxes, brokerage fees, storage fees or similar charges, may be payable by the Customer unless expressly stated otherwise.
MCCM reserves the right to change prices at any time. Price changes will not affect orders that have already been validly accepted, except where correction of an obvious pricing error is required.
9. PAYMENT
Payment must be completed using one of the payment methods made available at checkout.
MCCM may use third-party payment service providers to process transactions.
An order may remain pending until payment has been successfully authorised or confirmed.
If payment is declined, reversed or otherwise unsuccessful, MCCM may suspend or cancel the order.
The Customer confirms that they are authorised to use the payment method selected.
10. DELIVERY
MCCM will make reasonable efforts to dispatch accepted orders within the estimated timeframe communicated to the Customer.
Delivery times are estimates and may be affected by factors outside MCCM's reasonable control.
For international orders, delivery times may be affected by customs clearance, local authorities, import requirements, carrier delays or other destination-country procedures.
10.1 Customer Responsibility for Receipt
The Customer is responsible for providing complete and accurate delivery information and for ensuring that someone authorised to receive the shipment is available where required.
The Customer is responsible for receiving the goods at the delivery address provided at checkout.
The Customer should inspect the external condition of the shipment upon delivery and, where possible, record any visible damage with the carrier.
If the Customer provides an incorrect or incomplete address, fails to collect a shipment, refuses delivery without a valid reason, or otherwise causes a failed delivery, any resulting costs may be charged to the Customer to the extent permitted by law.
10.2 Transfer of Responsibility for Receipt
The Customer is responsible for ensuring the practical receipt and collection of the goods at the delivery destination.
For international transactions, the Customer is also responsible for ensuring that all necessary import procedures are completed and that the shipment can lawfully be received.
Nothing in this clause excludes any mandatory statutory rights applicable to consumers or any liability that cannot legally be excluded.
11. INSPECTION UPON DELIVERY
Customers should inspect packages as soon as reasonably possible after delivery.
Visible damage to the external packaging should be documented and, where appropriate, reported to the carrier and to:
The Customer should retain the packaging, labels, batch information and other relevant documentation where a delivery or product issue is identified.
Failure to report an issue immediately does not automatically eliminate mandatory legal rights; however, prompt notification helps MCCM investigate and resolve issues efficiently.
12. PRODUCT STORAGE AND HANDLING
Once products have been delivered, the Customer is responsible for storing and handling them in accordance with:
-
the product instructions;
-
applicable storage conditions;
-
applicable professional requirements; and
-
applicable laws and regulations.
MCCM cannot be responsible for deterioration, damage or loss resulting from improper storage, transportation after delivery, handling, exposure to inappropriate conditions, misuse or use contrary to instructions.
13. PROFESSIONAL USE AND CUSTOMER RESPONSIBILITY
MCCM products should only be used in accordance with their intended purpose and applicable instructions.
Where professional administration or application is required, the Customer is responsible for ensuring that the relevant procedure is performed by a suitably qualified or trained professional.
MCCM does not assume responsibility for injuries, adverse outcomes, damage or losses arising from:
-
improper application;
-
use by an unqualified person where qualification is required;
-
use contrary to instructions;
-
inappropriate storage;
-
use outside the intended purpose;
-
failure to follow professional standards; or
-
failure to comply with applicable local legislation.
Nothing in these Terms excludes liability that cannot legally be excluded.
14. RETURNS, REFUNDS AND PRODUCT NON-CONFORMITY
Returns and refunds are governed by MCCM's Returns, Refunds and Delivery Policy, as amended from time to time.
No product should be returned without prior contact with MCCM unless otherwise required by applicable law.
Return requests should be sent to:
For health, safety, hygiene and regulatory reasons, products that have been opened, used, altered, contaminated or otherwise compromised may not be eligible for return, except where applicable law provides otherwise or where the return concerns a verified product non-conformity.
Where a product is alleged to be defective or non-conforming, MCCM may request photographs, batch numbers, packaging, proof of purchase or other information reasonably necessary to investigate the matter.
15. PRODUCT COMPLAINTS AND QUALITY INVESTIGATIONS
Any suspected product defect, packaging problem, damage or quality issue should be reported to:
The Customer should provide sufficient information to allow MCCM to investigate, including where applicable:
-
order number;
-
product name;
-
batch number;
-
photographs;
-
description of the issue;
-
delivery information; and
-
relevant supporting documentation.
MCCM may investigate complaints through its Quality Team and may request that the Customer retain the product and packaging pending completion of the investigation.
Where a genuine non-conformity attributable to MCCM is confirmed, MCCM will provide the remedy required by applicable law or, where appropriate, another commercially reasonable solution.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, MCCM shall not be liable for losses arising from:
-
improper or unlawful use of the website;
-
use of products contrary to instructions;
-
use by persons who are not appropriately qualified where qualification is required;
-
failure to comply with destination-country requirements;
-
customs or import restrictions;
-
incorrect information supplied by the Customer;
-
failure to receive or collect a shipment where attributable to the Customer;
-
improper storage or handling after delivery;
-
events outside MCCM's reasonable control; or
-
indirect or consequential losses that are not reasonably foreseeable.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory applicable law, including applicable consumer protection legislation.

Any such accommodation is granted on a case-by-case basis and does not constitute an amendment, waiver or precedent applicable to future transactions.
